This Policy governs the sale of outreach flights, gift vouchers and introductory courses (packs of 10 flights) through the website volavela.com (the “Website”), owned by Club de Vol a Vela d’Igualada-Òdena (the “Club”; NIF G60124294; info@volavela.com). The Club’s full details are set out in the Legal Information page.
Only the following services are sold through the Website, and they are provided directly by the Club:
Temporary membership. By entering into a contract for any of these services, the person who will fly obtains temporary membership of the Club for the day of the flight (for the pack, until the contracted flights have been taken within their validity period), and the Club assigns them a transient member number. The Club is a non-profit sports association whose main purpose is to promote the practice of gliding among its members. All the Club’s tasks and services are provided selflessly by its members.
No physical goods are sold.
2.1. Who may buy. Purchases must be made by persons aged 18 or over with the capacity to enter into contracts. The Customer may buy the flight for themselves or for another person (“the person who will fly”). If buying for another person, the Customer undertakes to hand them the voucher, which includes the information on how their data is processed.
2.2. Steps.
The contract is concluded when the Customer receives the purchase confirmation by email, once the payment has been accepted.
For the pack, the remaining flights are booked afterwards, within the validity period, by contacting the Club at info@volavela.com.
3.1. Physical and safety requirements. Before paying, the Customer must check that the person who will fly meets the requirements to make the flight safely. The weight and height limits in force are shown on the purchase form, next to the corresponding fields.
The Club does not carry out medical assessments or diagnoses; it only provides information on the requirements and circumstances that may affect the safe conduct of the flight. If the Customer has any doubts, they can ask at info@volavela.com before buying.
The purchase form automatically applies the weight and height limits shown on it: if the weight or height entered are outside them, the purchase cannot be completed online. In that case, the Customer can write to info@volavela.com so that a person at the Club reviews their situation.
3.2. Legal document. On the day of the activity, before flying, a legal document will be signed providing information on, and acceptance of, the conditions of participation and the risks inherent to the flight. Signing this document is required in order to take the flight.
3.3. Minors. If the person who will fly is under 18, their parent or legal guardian must be present on the day of the activity and sign the corresponding document.
3.4. Flight not carried out because requirements are not met. The Club will not carry out the flight if:
a) the person who will fly does not meet the requirements in section 3.1 or the data provided are not accurate;
b) they arrive under the influence of alcohol or of substances that may compromise the safety of the flight;
c) they do not follow the instructions of the pilot or the Club’s staff;
d) they are under 18 and their parent or legal guardian is not present or does not sign the document; or
e) they do not sign the legal document in section 3.2.
If the flight is not carried out because the person who will fly does not meet the requirements in section 3.1, the Club refunds the full amount of the flight. In the cases in letters b), c), d) and e), what section 8.2 provides for no-shows applies.
3.5. Insurance. The Club has insurance that covers the people who take part in the flights.
4.1. Prices are shown on the Website in euros (€). The final price is shown on the purchase form before paying. The price includes temporary membership of the Club (for the day of the flight and, for the pack, until the contracted flights have been taken within their validity period), the aircraft tow and the flight time.
4.2. Payment is made in full and in advance, at the time of purchase, through the payment service provider and with the payment methods enabled at any given time, including Visa and Mastercard cards. The Club does not offer instalment or partial payment through the Website.
4.3. The Club does not store, and does not have access to, the full details of payment cards. It may receive transaction-related information from the payment provider, such as the amount, the payment status or the transaction identifier.
4.4. Payments made in person at the Club’s premises (for example, in cash) are not part of the online purchase process and are not governed by this Policy, but by the Club’s conditions for in-person sales.
The services sold (outreach flights, gift vouchers and introductory courses in the form of a pack of 10 flights) are flights that are provided and enjoyed at the Club’s facilities. Therefore no physical product is shipped or delivered, and there are no shipping costs or transport-related delivery times. The service is “delivered” by actually carrying out the flight on the chosen date.
6.1. Flight date. The date and time of the flight (for the pack, those of the first flight) are always chosen at the time of purchase.
6.2. Validity of the pack. The ten (10) flights in the pack must be taken within a maximum of six (6) months from the date of purchase, without prejudice to section 7. After that period, flights not taken for reasons attributable to the Customer expire, with no right to a refund.
6.3. Weather and operational conditions. Gliding depends on the weather (wind, visibility, thermals, etc.) and on the operational availability of aircraft and staff. For this reason the Club may cancel or postpone a flight whose date has already been chosen if it cannot be carried out safely. Where the cancellation is not attributable to the Club, it does not give rise to compensation, without prejudice to section 7 and to the rights that the law grants the Customer.
6.4. Daily capacity and delays. Because of the Club’s structure, the number of outreach flights is limited each day. Unforeseen delays to the scheduled time may occur for various reasons (training, refuelling, incidents, maintenance, etc.).
The Club may cancel a flight for weather or safety reasons, or because of a breakdown or the unavailability of aircraft or staff. In that case:
a) The Club informs the Customer as soon as possible, by email or phone.
b) The Club proposes an alternative date, or the Customer may choose another among those available in the calendar, at no cost.
c) The Customer has 3 months from the cancellation notice to take the flight. For the pack, if the 6-month validity period from purchase would end earlier, it is extended until those 3 months have elapsed.
d) If the Club cancels the flight again, the 3-month period runs again from the latest notice.
e) If the Club cannot offer any date within that period, the period is extended up to a maximum of 12 months from the first notice of the cancellation of that flight or, if it ends later, until the end of the period in paragraph d). If, after that extended period, the flight could not be carried out for reasons attributable to the Club (because it could not offer any date or because it cancelled the dates offered), the Club refunds the Customer the price paid for the individual flight or, for the pack, the pack price divided by 10 for each flight that has not been taken, is not considered used (section 8.2) and has not expired for reasons attributable to the Customer. The refund is made using the same payment method, at no cost to the Customer, without undue delay and, in any case, within 14 calendar days from the end of that extended period.
f) If, when dates are available, the Customer does not take the flight within the period for reasons attributable to the Customer (for example, not choosing a date or not showing up), the flight expires with no right to a refund.
g) The above is without prejudice to the rights that consumer law grants the Customer if the service ends up not being provided.
8.1. Date change. The Customer may request a date change free of charge, with a minimum notice of 48 hours, subject to availability and within 3 months of the originally chosen date (for the pack, within its validity period).
8.2. No-show. If the Customer does not show up on the day and at the time of the flight without having requested the change with the notice stated above, the flight is considered used, unless there is justified force majeure.
8.3. Cancellation by the Customer. Except as provided in section 9 and section 7, cancellation by the Customer does not give rise to a refund, without prejudice to the date change in section 8.1 and the transfer in section 8.4.
8.4. Transfer of the flight. The Customer may transfer, free of charge, the individual flight or the pending flights of the pack (all or some of them) to another person, by notifying info@volavela.com with a minimum notice of 48 hours and giving the new person’s first name, surname, weight and height. The new person must meet the requirements in section 3. The Club may refuse the transfer if the new person does not meet them, in which case the Customer keeps the flight. The transfer does not change the chosen date or any period in this Policy (in particular, the validity of the pack and the periods in sections 7 and 8.1).
9.1. Individual flight. The date and time of the individual flight are fixed when the contract is made. It is therefore a leisure service with a specific date of performance, and the Customer has no right of withdrawal (article 103(l) of the consolidated text of the General Law for the Defence of Consumers and Users, Royal Legislative Decree 1/2007, “TRLGDCU”). Before paying, the Customer confirms this by ticking this box:
☐ “I am aware that this flight is booked for the date and time I have selected and that, for this reason, I have no right of withdrawal (article 103(l) of the TRLGDCU).”
This does not affect date changes (section 8.1) or section 7 when the Club cancels the flight.
9.2. Pack of 10 flights. A Customer who is a consumer has the right to withdraw from the contract within 14 calendar days of purchase, without having to give a reason.
If the date of the first flight, or of any other flight of the pack booked later, falls within those 14 days, the Customer must expressly request that it take place within the period by ticking this box. Without it, the Club does not confirm flights within the withdrawal period:
☐ “I expressly request that the flight take place before the 14-day withdrawal period ends. I understand that, if I withdraw once the service has started, I must pay the proportionate part already provided, and that, if the service is fully performed, I will lose the right of withdrawal.”
If the Customer withdraws after taking any flight under that request, the price paid for the pack is refunded minus the proportionate part already provided, which is calculated on the price paid for the pack (the pack price divided by 10, for each flight taken). If the service has been fully performed, the Customer loses the right of withdrawal (article 103(a) of the TRLGDCU). After the 14 days, the right of withdrawal lapses.
9.3. How to withdraw and refund. The Customer must state their decision unequivocally to info@volavela.com, giving their name and the reference and date of the purchase. They may use the model form in Annex I, although this is not mandatory. The Club refunds the amount using the same payment method, without undue delay and, in any case, within 14 calendar days from being informed of the decision to withdraw.
After each purchase, the Customer receives the payment receipt. If they need an invoice, they can request it at info@volavela.com, giving their tax details.
For any query about the purchase, a date change, cancellations or withdrawal, the Customer can write to info@volavela.com.
The Customer may submit a complaint to the Club at info@volavela.com. The Club is not a member of the Consumer Arbitration System or of any other consumer alternative dispute resolution body, and is not required by any rule to take part in them. If a complaint submitted directly to the Club is not resolved, the Club will inform the consumer of at least one accredited alternative dispute resolution body that is competent to hear it, and will state whether it accepts its involvement. The Customer may also contact the competent consumer authorities in their area.
(Complete and return this form only if you wish to withdraw from the contract for the Pack of 10 flights.)
